Public offer for the conclusion of a contract for the provision of daily apartment rental services

Real the offer is an official public offer to any individual or legal entity (hereinafter referred to as the Guest) individual entrepreneur Anatoly Yuryevich Solonko, OGRNIP 324470400088056 (hereinafter referred to as the Contractor) to conclude an agreement on the provision of daily apartment rental services (hereinafter referred to as the Agreement) on the terms and conditions set out below.

This offer includes the text of the Agreement.

Payment for the Contractor’s services by the person to whom this offer is addressed constitutes acceptance, i.e. full and unconditional, without any exceptions, acceptance of the terms of the Agreement (in accordance with paragraph 3 of Article 438 of the Civil Code of the Russian Federation). Acceptance means the presence of informed, specific and conscious consent to all the terms of the Agreement.

From the moment the payment for services is received into the Contractor’s bank account, the Agreement is considered concluded and the person who has accepted it acquires all the rights and obligations of the Guest stipulated by the Agreement.

Taking into account the above, please read this offer carefully. If you do not agree with its terms, the Contractor suggests that you refuse to conclude the Agreement.

 

Subject of the agreement

1. The subject of this Agreement is the provision by the Contractor to the Guest of the daily rental service of Apartments (hereinafter referred to as the “Apartments”).”), under the terms of the offer, the approved rules of visiting and in accordance with the current tariffs published on the website: https://so-spb.com.

2. Services are considered to be rendered of due quality and within due time at the moment the Guest is granted access to the Apartments.

 

Making a reservation, changing and cancelling

3. The booking is made by the Guest on the official website of the Contractor https://so-spb.com (hereinafter referred to as the “Site”) With using the online booking module, by phone, via messengers, specified in the contractor’s details and on the Website or by filling out the business trip form.

4. The addresses, square footage, number of beds and other characteristics of the Apartments, and the rental cost of the Apartments are indicated on the Website.

5. The Apartments selected by the Guest are booked by the Contractor for the period from the arrival date to the departure date specified during the booking.

6. The Contractor reserves the Apartments upon receipt of the advance payment. services and within 24 hours sends the Guest an email/message confirming the booking.

7. The guest has the right to request a change in the booking or cancel the booking no later than 2 weeks before check-in. In case of cancellation of the booking after the specified period, the amount of the payment made is not refundable.

8. If the Guest fails to check into the Apartment on the check-in date, the reservation will be cancelled by the Contractor and the previously made payment will not be refunded.

 

Rights and obligations of the parties.

9. The Contractor under takes to:

9.1. Make a Booking of the Apartment and provide the services included in the cost of the order; draw up documents giving the Guest the right to receive the ordered and paid services and transfer copies of these documents in electronic form to the Guest, upon his request.

9.2. Eliminate all malfunctions in the Apartments that do not arise through the fault of the Guest, maintain the Apartments and the equipment installed by the Contractor in good working order. In the event of any malfunctions, emergency situations or the threat of their occurrence in the premises, the Contractor undertakes to take the necessary measures to eliminate them within a reasonable time.

9.3. Use all personal data and confidential information received from the Guest only for the purpose of providing services under the Agreement.

10. The Guest undertakes to:

10.1. Review the tariff plans, provisions of this offer and visiting rules, agree to the provisions on the processing of personal data posted on the Contractor’s website, make a request by filling in the required fields in the online booking module for Apartments or by phone, or through agreed messengers.

10.2. Make payment for the cost of services.

10.3. Ensure the safety of the Apartments and the property of the Contractor and maintain the Apartments in proper condition. In the event of damage to the Apartments or the property of the Contractor due to the fault of the Guest, accompanying persons and visitors, the Guest undertakes to reimburse the Contractor for the cost of replacing the damaged property, with compensation being made as for new similar property. In the event of theft of the property of the Contractor, the Guest undertakes to reimburse the full cost of the lost property, with compensation being collected as for new similar property. The Guest, throughout the entire period of stay in the Apartments and the validity of this Agreement, regardless of the actual location of the Guest, bears full responsibility for the safety of the property of the Contractor.

10.4. Comply with the Rules for visiting the Apartments (Appendix No. 1 to the Agreement).

 

Cost of services and payment procedure for Guests – individuals

11. The cost of services depends on the rate chosen by the Guest and is indicated on the Website in the online booking module. The cost of the rate includes accommodation for two guests, for the third and fourth guests an additional payment of 1,000 (one thousand) rubles is made for each.

12. Payment for services is made by any of the methods offered by the Site. Payment for services is an acceptance of the offer.

13. After selecting the arrival/departure dates and the number of guests, the Guest makes an advance payment of 20% of the booking cost, the remaining amount is paid upon check-in.

14. In case of cancellation of the booking, the refund is made in accordance with the terms of the rate selected by the Guest during booking.

15. If a reservation is cancelled due to the Guest not arriving at the Apartment, the money paid under the Agreement will not be returned.

16. The fact of receipt of funds is confirmed by a notification to the Guest’s e-mail or a cash receipt, which is sent upon request.

17. Before granting the Guest access to the Apartments, the latter shall make a deposit in the amount of 10,000 (ten thousand) rubles, which shall be returned upon vacating the Apartments, provided that no damage has been caused to the property of the Contractor and there are no grounds for imposing fines on the Guest in accordance with the terms of the Agreement and/or the Rules for visiting the Apartments.

 

Cost of services and payment procedure for legal entities

18. The cost of services depends on the selected tariff and is indicated on the Website in the online booking module.

19. For Guests – employees of legal entities Daily Apartment rental services are provided after preliminary agreement of arrival dates upon 100% prepayment based on the invoice issued by the Contractor. Documents confirming the fact of service provision are sent to the legal entity’s e-mail address after the service has been provided.

 

Final Provisions

20. The Agreement is considered concluded and acquires legal force from the moment the Guest accepts this offer. If the Guest does not accept the terms of the offer in full, the Contractor will not provide services.
21.  The Agreement shall terminate at the moment of full performance by the parties of their obligations under it.

22. The Parties are obliged to maintain confidentiality with respect to any information that becomes known to them as a result of the conclusion and execution of the Agreement. The conditions of confidentiality do not apply to information that is publicly available, cannot be classified as a commercial or other secret, and is intended by its nature for use by third parties.

In all matters not provided for by this Agreement, the Parties shall be guided by the current legislation of the Russian Federation.

23. Disputes and disagreements between the parties will be resolved through negotiations. If it is impossible to reach agreement during negotiations, the dispute will be referred to the court at the location of the Contractor.

Appendix No. 1
 to the agreement on the provision of daily apartment rental services

 Rules for visiting apartments

1. Standard check-in time for apartments is from 15:00, check-out is until 12:00, earlier check-in/late check-out can be adjusted individually.
2. Please respect our agreements. The apartment must contain as many people as agreed upon check-in.
3. Accommodation with any animals is not provided.
4. It is prohibited to hold parties or make noise in front doors and courtyards.
5. Smoking hookah, cigarettes, and electronic cigarettes is prohibited in all areas, including entryways and courtyards.
6. We ask you to remain quiet at night (11:00 pm – 9:00 am) and not to enter into conflicts with your neighbors.
7. When leaving, leave behind clean dishes and equipment.
8. Please do not rearrange the furniture.
9. When leaving the apartment, turn off electrical appliances and lighting.
10. If you accidentally break a mug, plate, glass, or notice that the equipment is not working, please inform the manager. We treat such situations with understanding and will be grateful for your honesty.
